THE TERM cAGREEMENT c AS USED IN THIS SECTION SHALL REFER TO THE TERMS CONTAINED IN THIS BOOKLET.
RESPONSIBILITY: I agree to repay all debts and FINANCE CHARGES arising from the use of my card. I am responsible for all charges incurred by myself, my spouse, minor children and any other party or parties to whom I give the card, and this responsibility continues until the card is recovered. I cannot disclaim responsibility by notifying you, although you will close the account to new transactions, if I so request and return all cards to you.
My obligation to pay the account balance and all other accrued costs continues even though an agreement, divorce decree or other court judgment to which you are not a party may direct some other party to pay the account. FINANCE CHARGES, CREDIT CARD PURCHASES AND CASH ADVANCES: A FINANCE CHARGE will be imposed on all credit card purchases (and cash advances by the application of a daily periodic rate and corresponding ANNUAL PERCENTAGE RATE) to the cBalance Subject to Finance Charge d indicated on my monthly billing statement.<br><br> The cBalance Subject to Finance Charge d is the average daily principal balance of one of the following amounts: a) purchases and cash advances made during the statement period, if I had no Previous Balance or if the Previous Balance was paid in full by the Payment due Date indicated on my monthly statement or b) the principal portion of my Previous Balance, reduced by payments made and credits applied to the account, and increased by cash advances, purchases made or debit adjustments made during the statement period if I did not pay the Previous Balance in full before the Payment Due Date shown on the previous statement. The daily Principal Balance of these amounts are totaled and divided by the number of days in the billing cycle resulting in the cBalance Subject to Finance Charge d. Cash advances and purchases are thus subject to FINANCE CHARGE from the date of posting to my account.<br><br> FINANCE CHARGES after the Statement Closing Date can be avoided by paying the New Balance on or before the Payment Due Date, all as shown on the monthly statement. FINANCE CHARGES, CREDIT CARD CASH ADVANCES: A FINANCE CHARGE will be imposed on all Cash Advances that I receive through the use of my card during the current billing cycle from the date of each such Cash Advance or from the /rst day of the billing cycle in which the Cash Advance is posted to the account, whichever is later, and will continue to accrue until paid if paid during the same billing cycle as made, or if not paid in full during the same billing cycle as made, the FINANCE CHARGE will continue to accrue on the unpaid balance until the closing date of the billing cycle preceding the date on which the entire new Balance is paid in full or until the date of payment if more than 25 days from the statement closing date. If the New Balance indicated on my statement for the prior monthly period is paid in full within 25 days of the closing date, no FINANCE CHARGE will be imposed during the current billing cycle for the Credit Purchases made during the previous billing cycle.<br><br> The FINANCE CHARGE for a billing cycle is computed by applying the monthly periodic rate to the average daily outstanding unpaid principal balance of Cash Advances, which is determined by dividing the sum of the daily balances during the billing cycle by the number of days in the cycle. Each daily balance of Cash Advances is determined by adding to the previous balance any new Cash Advance as of the transaction date or the /rst day of the billing cycle in which posted, whichever is later, and subtracting each payment and credit on the date of receipt, but excluding any unpaid FINANCE CHARGE. A FINANCE CHARGE will be imposed on Credit Purchases of goods and services that I obtain through the use of my card only if I elect not to pay the entire New Balance shown on my previous monthly statement within 25 days from the closing date of the statement.<br><br> If I elect not to pay the entire New Balance shown on my previous monthly statement within 25 days from the closing date of the statement, a FINANCE CHARGE will be imposed on the unpaid balance of Credit Purchases from the statement closing date and on Credit Purchases made during the current billing cycle from the date of posting each such Credit Purchase to the account and will continue to accrue until the closing date of the billing cycle preceding the date on which the entire New Balance is paid in full or until the date of payment if more than 25 days from the closing date. This credit limit is self replenishing. I agree not to exceed my speci/ed credit limit at any time.<br><br> I may request an increase in my credit limit at any time. If you, for any good reason, decide to terminate my credit card privileges, I understand that I remain liable to pay all amounts owed at the time and I agree to return all the cards which have been issued to me or to any party designated by me. USING THE CARD: I may use any of the following methods to make a purchase or cash advance: a) I may present the card to a participating merchant, to you or to another /nancial institution, and sign the sales slip or cash advance draft which will be imprinted with my card: or b) I may complete a transaction by using my Personal Identi/cation Number (PIN) in conjunction with my card at an Automated Teller Machine (ATM) or other type of electronic terminal which provides access to the credit card system; or c) I may give my card number verbally or in writing to a merchant to complete a mail or telephone transactions; or d) I may use any pre-printed Convenience Checks that you may issue to me.<br><br> My periodic statement will identify the merchant, electronic terminal or /nancial institution, at which the transactions were made, but sale, cash advance, credit or other slips cannot be returned with the statement. I will retain my copy of such slips furnished at the time of the transactions in order to verify the statement. VARIABLE RATE: The ANNUAL PERCENTAGE RATE (interest rate) for unsecured credit cards is calculated by adding the Prime Rate as published the last business day of the previous month in the Wall Street Journal PLUS the designated MARGIN or cspread d in effect at the time of your loan.<br><br> Your ANNUAL PERCENTAGE RATE (interest rate) may increase or decrease if there is a similar increase or decrease in the Prime Rate. Your ANNUAL PERCENTAGE RATE (interest rate) may also increase or decrease based on a similar increase or decrease in the designated MARGIN, but not before giving advanced notice as required by law. The ANNUAL PERCENTAGE RATE (interest rate) for 100% share secured credit card accounts is the current share/club dividend rate posted by Tucson Federal Credit Union, plus a designated margin.<br><br> The variable rate for credit card accounts may be changed on the 1st day of each month. The actual rate assigned to your account will be based on your FICO or similar score obtained at the time of application and at annual review. Your account is reviewed annually for a possible rate adjustment.<br><br> There is no limit on the percent by which the rate can change in any one year period. MONTHLY PAYMENT: Each month I will receive a statement from the Credit Union showing my Previous Balance of Credit Purchases and Cash Advances, the current transactions on my account, the unused portion of my credit limit available to me, the FINANCE CHARGE due, the total New Balance and the minimum payment required. I agree to pay at least the minimum payment due upon receipt of the statement.<br><br> I may pay more frequently, pay more than the minimum payment or pay the entire balance due without penalty. The minimum payment will be 3.0% of my total new balance or $10.00, whichever is greater, or my total New Balance if it is less than $10.00, plus any portion of the minimum payment(s) remaining unpaid from previous statements. If my total new balance exceeds my credit limit at any time, I must immediately pay the excess amount in addition to the regularly scheduled payment.<br><br> Payments will be applied /rst to late charges, then to FINANCE CHARGE due on Credit Purchases and Cash Advances, then to the outstanding principal balance of Cash Advances and Credit Purchases previously billed, then to current Cash Advances and Credit Purchases. If two or more transactions are posted on the same day, my payment will be applied /rst to the smaller of them. Payments are subject to posting delays of up to /ve (5) business days if received at any address other than the address designated in the monthly statement for mailing purposes.<br><br> CHARGES MADE IN FOREIGN CURRENCY: If I incur a charge in a foreign currency, the currency will be converted by Visa International into a United States Dollar amount. Visa International will use the procedures set forth in its Operating Regulations in effect at the time that the transaction is processed. Currently, those regulations provide that the currency conversion rate to be used is a rate selected by Visa from the range of rates available in wholesale currency markets for the appli- cable central processing date, which rate may vary from the rate Visa itself receives, or the government-mandated rate in effect for the applicable central processing date, in each instance, plus or minus any adjustment determined by the Issuer.<br><br> CHANGE IN TERMS: This agreement is subject to change pre-disclosed by Tucson Federal Credit Union. Tucson Federal Credit Union may change any of the terms and conditions of this Agreement, including the ANNUAL FINANCE CHARGE imposed on my balance, at any time with proper advance notice. CREDITS: If merchants who honor my card give me credit for returns or adjustments, they will do so by sending you a credit slip which you will post to my account.<br><br> If my credits and payments exceed what I owe, you will hold and apply this credit balance against future purchases and cash advances, or refund it if it is for $1.00 or more at my written request, or automatically after six (6) months. SECURITY INTEREST: I grant you a contractual pledge of all shares and deposits and earnings on all shares and deposits I have with you now or in the future. I understand that the endorsement in the application for Credit signed by me contains verbiage by which I speci/cally grant you this security interest in my asset accounts with you.<br><br> Collateral securing other loans with you may also secure this loan, except for my principal dwelling and household goods. PLAN MERCHANT DISPUTES: You are not responsible for the refusal of any plan merchant or /nancial institution to honor my card. You are subject to the claims and defenses (other than tort claims) arising out of goods and services I purchase with the card only if I have made a good faith attempt but have been unable to obtain satisfaction from the plan merchant.<br><br> I am responsible for the /rst $50.00 of any transaction made using my PIN at an Automatic Teller Machine or other cash dispensing device. Any other disputes I must resolve directly with the plan merchant. These limitations do not apply if the Credit Union owns or operates the merchant or mailed me the advertisement for the property or services.<br><br> AMENDMENTS: You may change any part of this Agreement at any time, as long as you give me advance written notice as required by law. Any change in terms will apply to my outstanding balance existing as of the effective date as well as to all charges made after that date. CHANGE OF ADDRESS: I will advise you promptly if I change my mailing address.<br><br> All written notices and statements from you to me will be considered given when placed in the United States mail, postage prepaid, and addressed to me at my current address as it appears on your records. SKIP PAYMENT OPTION: At your option, you may not require me to make a minimum payment during certain designated billing cycles. If I do not make my minimum payment as provided in the Agreement, I understand you will continue to accrue /nance charges to my Account.<br><br> Beginning with the billing cycle following a skip payment, I agree that all of the provisions of this Agreement shall apply. CANCELLATION: I can cancel my Account at any time by returning you my card, along with a letter requesting that you cancel my Account. You may cancel this Agreement at any time.<br><br> However, my obligation under this Agreement and any charges made under it prior to cancellation will continue to apply until I have paid you all of the money I owe on the Account. DEFAULT: I will be in default if I fail to make any minimum payment on the Payment Due Date shown on my monthly statement. I will also be in default if my ability to repay you is materially reduced by an increase in my obligations, bankruptcy or insolvency proceedings involving me, my death or my failure to abide by this Agreement, if I exceed my stated credit limit and fail to pay the excess with the next payment, or if the value of your security interest materially declines, or if I am in default under any other Agreement I have with you.<br><br> You would, at that time, have the right to demand payment on my entire account balance, subject to your providing me with any legally required notice. I will also be liable for all costs of collections. RETENTION OF CARD: If I fail to keep any agreement I have with you, you may, without any prior notice, terminate my account and demand the immediate surrender of all cards issued on this account.<br><br> My cards may be retained or destroyed by a merchant or electronic terminal upon use of the card after you have terminated my account. EFFECT OF AGREEMENT: This agreement applies to all transactions on my credit card account, even though the sales, cash advance, credit or other slips I sign contain different terms. You may modify this Agreement from time to time with written advance notice, and my continued use of the card after receiving notice of any change in terms certi/es my acceptance to the new terms.<br><br> To the extent the law permits, and you indicate in your notice, changes in terms will apply to my existing account balance as well as to future transactions. LIABILITY DISCLOSURE: I will notify the Credit Union AT ONCE if I believe that my credit card has been lost or stolen. Telephoning is the best way of keeping my possible losses down.<br><br> I understand that my total liability to the Credit Union shall not exceed $50.00 for any card transactions resulting from the loss, theft or other unauthorized use of the card that occurs prior to the time I gave notice to you. Such liability does not apply when the card is used to make an electronic transfer. EMERGENCY LIMIT INCREASE: If I request and am granted an emergency limit increase, I will be charged $10.00.<br><br> LATE PAYMENT FEE: If my payment is 10 or more days delinquent, I will be charged a monthly late fee of 20.00% of interest accrued since the date of the previous payment, with a $15.00 minimum. FEES FOR DOCUMENTS: If I request a copy of a charge slip or other document not in connection with a billing error, I will be charged $5.00 per copy. You must hear from me no later than 60 days after you sent the /rst bill or statement on which the error or problem appeared. I can telephone you, but doing so will not preserve my rights.<br><br> In my letter I must give you the following information. 1. My name and account number.<br><br> 2. MY RIGHTS AND RESPONSIBILITIES AFTER YOU RECEIVE MY WRITTEN NOTICE. You must acknowledge my letter within thirty (30) days, unless you have corrected the error or explained why you believe the bill or statement was correct.<br><br> After you receive my letter, you cannot try to collect any amount I question, or report me as delinquent. You can continue to bill me for the amount I question, including /nance charges, and you can apply any unpaid amount against my credit limit. I do not have to pay any questioned amount while you are investigating, but I am still obligated to pay the parts of my bill that are not in question.<br><br> If you /nd that you made a mistake on my bill or statement, I will not have to pay any /nance charges related to any questioned amount. In either case, you will send me a statement of the amount I owe, and the date that it is due.<br><br> If I fail to pay the amount you think I owe, you may report me as delinquent.
