TA has also continued its studies through the year 2004 with an extraordinary performance in order to realize the liberalization in the sector. One may say that the most important development in the sector for the year 2004 was the authorization of Long Distance Telephony Services (LDTS), which enables the provision of voice telephony services by alternative operators other than Türk Telekom, which is regarded as a symbol of liberalization.<br><br> Principles and procedures in relation to the authorization of LDTS which includes provision of intercity and/or international telephony services by using any kind of technology over any kind of telecommunications network and infrastructure were published in the Official Gazette on April 13, 2004. The studies towards the authorization of services other than the LDTS have also continued and in the year 2004, 67 new operators have entered into the sector and the number of operators has increased to 192. From the 67 new operators, 43 operators have been authorized in LDTS, 3 operators have been authorized in satellite communications services, 1 operator has been authorized as GMPCS mobile telephone operator, 11 operators have been authorized in data transmission over terrestrial lines services and 9 operators have been authorized in common usage radio services.<br><br> The increase in the number of operators enables consumers to enjoy higher quality of service with lower price. At the same time, it contributes to the macro-economy by creating new employment opportunities, tax revenue increase, growth of investments and improved level of competition. Another important development in the sector was the publication of the standard reference interconnection tariffs by the TA on September 16, 2004 that includes call origination and termination charges at Türk Telekom 9s network as well as the termination charges at GSM networks.<br><br> The publication of standard reference interconnection tariffs, which is a basic input for the operators, performs one of the most important steps in the liberalization process. Developing the infrastructure, using the current infrastructure in an efficient manner and encouraging the investments, incentives and technological improvements constitute the basic idea of interconnection regulations, in this regard; standard reference interconnection rates have special importance. In year 2004, some important changes have been recorded in the structure of GSM sector as well.<br><br> It was the year 1994 when two GSM-900 operators, namely Turkcell and Telsim had begun to provide GSM services in the sector. The number of operators increased to 4 with the entry of two new GSM-1800 operators namely, 9M-Tim (Aria) and Aycell. On February 19, 2004 Aycell and Aria have been officially merged under the brand name of Avea.<br><br> Consequently, GSM ÖNSÖZ PREAMBLE line gelmiMtir. Another important development in the GSM sector is the transfer of Telsim 9s management rights to the SDIF (Savings Deposit Insurance Fund) in accordance with the relevant articles of the Banks Law.<br><br> Naturally; this development increased our work load in the year 2004. In addition to those mentioned above, other important developments noted in the year 2004 can be summarized as follows; TA has determined the leased lines tariffs on cost oriented basis and realized reductions up to 50% especially in high speed and long distance leased lines tariffs, which are quite important issues for the operators and the sector. In this new format, the leased line market is divided into two segments as wholesale and retail markets, and therefore the operators enjoy the wholesale tariffs without any time constraint.<br><br> As stated in the Work Plan 2004, TA has completed its studies for the "Ordinance Related to Authorization of Telecommunications Services and Infrastructures", "Communiqué on the Terms and Conditions of Unbundled Access to the Local Loop", "Numbering Ordinance", "Ordinance on Data Security and Consumer Rights". These regulations came into force upon their publication in the Official Gazette. Also as promised in the Work Plan 2004, the studies towards the authorization of Cable TV Services and Broadband Fixed Wireless Access Services have been completed.<br><br> Minimum license fees for those services are sent to the Ministry of Transport for approval by the Council of Ministers. Also, the rules and principles to be applied for those services are sent to Prime Ministry for publication in the Official Gazette. Apart from that, TA has provided effective and extensive support for the Electronic Communications Law drafted in order to review, update and unify the legislative structure specific to telecommunications industry.<br><br> Moreover, within the framework of Electronic Signature Law; "Ordinance on Certificate Financial Liability Insurance", "Ordinance on the Procedures and Principles Pertaining to the Implementation of Electronic Signature Law" and "Communiqué on Processes and Technical Criteria Regarding Electronic Signatures" are finalized and published in the Official Gazette long before the deadline. Meanwhile, monitoring task have also been actively carried out and joint study has been started with the Ministry of Justice, Ministry of Interior, Ministry of Finance, Undersecretariat of Foreign Trade and other related institutions to prevent the entry of illegal GSM handsets to our country and necessary steps are taken with the support of international institutions. In conducting its studies, TA considers the EU Directives and implementations in EU countries, takes the necessary lessons from the experiences noted in those countries in order not to experience the same mistakes for our country. When we examine the studies conducted by different countries for liberalization, it is seen that such studies were completed in about 10 year 9s time.<br><br> TA on the other hand, has accomplished these studies in a relatively short period of time as 2-3 years. The studies are conducted not considering the daily changes but conducted long term envisage considering the fact that telecommunications sector is the major sector which provides major contribution to the Turkish economy. Our purpose is to bring telecommunications sector to an internationally competitive level.<br><br> This can be achieved by the functioning of alternative operators in effective and sound manner in the sector. Prepared with this understanding, Work Plan 2005 comprises new authorizations to be defined such as value added telecommunications services, mobile virtual network service, infrastructure service operator and terrestrial digital platform service operator and revision of present authorizations in line with the new conditions developed in the sector. In order for the operators to provide their services in compliance with national and international quality standards, the necessary quality of service parameters will be determined and the operators shall be encouraged to conform to such parameters.<br><br> The definition of relevant markets in telecommunications sector shall be made in accordance with EU recommendations. The operators having significant market power in those markets shall be determined and the necessary regulatory tools shall be implemented to have a more competitive market. At the same time, studies such as preventing the dominant power of the incumbent operator aiming to hinder the entry of operators to the market, number portability, market analysis, market monitoring and preventing the applications that can violate the competitive structure of the market, shall also be conducted this year.<br><br> While preparing those regulations, harmonization with the relevant EU legislation and other practices noted in the world as well as requirements of our country shall be taken into consideration as usual; and no concession shall be given from the transparency and impartiality principles while conducting those studies. With this understanding, I hereby introduce you the Work Plan 2005 prepared in line with the sector 9s requirements. Number Portability Preparation of the rules and procedures on the application of number portability which is defined as changing telephone operator or physical location or type of service without changing telephone number on PSTN/mobile networks With the implementation of number portability, subscribers will be able to change their telephone operator or physical location or type of service without changing their telephone numbers on PSTN/mobile networks. Thus, number portability will make contribution in improving the competition in the telecommunications market.<br><br> Basically, the scope of studies on number portability includes preparation of ordinance and application procedures in this regard. According to EU Universal Service Directive (2002/22/EC), number portability should be applied on PSTN/mobile networks. In that respect, to implement number portability on public telephony networks considering the priorities to be determined, studies covering technical solutions, cost allocation methods etc.<br><br> will be performed. In Turkey, there is no number portability implementation yet. This study includes to constitute a common database to which both the IMEI numbers of legal GSM telephones and the IMEI numbers of illegal or stolen GSM telephones are recorded and by this way, monitoring GSM telephones dynamically and then by using appropriate system to cancel the calls made with illegal phones and to trace illegal telephones in international arena. With the Board Decision, on 14.07.2004 and number 2004/386, it has been decided to get a computer system including main server and server peripherals for constructing an electronic infrastructure to take necessary precautions.<br><br> It is believed that this system will prevent illegal export of GSM telephones and will help to collect tax of existing illegal GSM telephones and also help to reduce number of thieving in this area. Strategy Working for Third Generation (3G) Mobile Systems Preparation of a Strategy Work related to Authorization and Regulations on 3G services that can be offered over 3G mobile systems at different frequency bands It is aimed to do a SWOT analysis (strengths, weaknesses, opportunities and threats) on 3G services and infrastructures which can be applied at different frequency bands and prepare a strategy work for our country with the intention of bringing 3G technologies in Turkey. This study will cover the subjects such as 3G services and applications, 3G technologies, important components of Authorization of 3G, preparation of a strategy on the timing of the Authorization of 3G and in this scope analysis of the current conditions like economic and demand conditions in the related market of Turkish telecommunications sector, ensuring the compatibility on frequency allocation and technical standards with the worldwide applications.<br><br> In current situation, 2G (GSM) and 2.5 G (GPRS) services are provided in Turkey by the GSM operators authorized with concession agreement. Regarding the 3G, in 2002, a "UMTS National Coordination Committee" was established in coordination of the Authority but this committee has given a break in its studies.
